# 非實體投票條例

#### 國立臺灣科技大學學生會非實體投票條例

中華民國110年06月14日\
學生議會第13屆第3次臨時會通過全文共六條，自一百十年六月十四日施行。

#### 第一條

本條例依[選舉罷免法第六十二條](/ntustsacode/common/election-and-recall-act.md#di-liu-shi-er-tiao)第二項制定之。

#### 第二條

選舉委員會辦理選舉，因發生或可預見將發生天災或其他不可抗力情事，致實體投票無法辦理時，得經選舉委員會決議，以非實體投票辦理選舉。

第二份選舉公告發布後，選舉委員會得依[選舉罷免法第三十四條](/ntustsacode/common/election-and-recall-act.md#di-san-shi-si-tiao)及前項之規定，公告改以非實體投票辦理選舉。

#### 第三條

[選舉罷免法第十九條](/ntustsacode/common/election-and-recall-act.md#di-shi-jiu-tiao)及[第二十八條](/ntustsacode/common/election-and-recall-act.md#di-er-shi-ba-tiao)，於非實體投票，不適用之。

非實體投票之投票日，不得少於三日，投票起訖時間不得少於七十二小時。

非實體投票投、開票起訖時間及投票系統之設定及使用，由選舉委員會訂定，刊載於選舉公告。

#### 第四條

[選舉罷免法第二十五條](/ntustsacode/common/election-and-recall-act.md#di-er-shi-wu-tiao)、[第二十六條](/ntustsacode/common/election-and-recall-act.md#di-er-shi-liu-tiao)，於非實體投票，不適用之。

選舉人於非實體投票，應於規定時間內，憑本人校務資訊系統、電子郵件認證系統或其他選舉委員會公告可供辨識個人身分之帳號、密碼，至投票系統領取選票及投票。

#### 第五條

[選舉罷免法第三十條](/ntustsacode/common/election-and-recall-act.md#di-san-shi-er-tiao)、[第三十一條](/ntustsacode/common/election-and-recall-act.md#di-san-shi-yi-tiao)、[第三十二條](/ntustsacode/common/election-and-recall-act.md#di-san-shi-er-tiao)第一項及第二項，於非實體投票，不適用之。

非實體投票投票結束後，應由選舉委員會開啟投票系統統一開票，並透過網路全程直播。

非實體投票之無效票，由選舉委員會審查之，並準用[選舉罷免法第三十二條](/ntustsacode/common/election-and-recall-act.md#di-san-shi-er-tiao)第三項之規定。

#### 第六條

本條例自一百十年六月十四日施行。
